They were extremely anxious about how to protect his inheritance.  In fact, they were initially considering disinheriting him and came to us for legal advice.  We were able to set up and structure a trust for their son with conditions that he receive portions of his inheritance only if a) he completed a recovery plan and b) was able to maintain sobriety.  As a trustee, they chose their niece who is extremely responsible and knowledgeable about addiction. The trust gave her instructions to hold the majority of the inheritance and spend it as needed for his benefit. Our greatest accomplishment was being able to give this couple some peace and sense of relief.

In addition to addressing financial concerns, it's essential to plan for parents to plan for the possibility of incapacity. Healthcare directives and powers of attorney allow parents to designate someone to make medical and financial decisions on their behalf if they become unable to do so themselves.

• Facilitating Open Communication:
